Property Rights in Post - WTO China: Success and Challenge |

| Abstract: |
China’s accession to the World Trade Organization (WTO) in 2001 demonstrates its transformation from a planned economy integrated into the global market system. China has achieved considerable progress in post-WTO property protection. To comply with its commitments under international treaties serves as impetus for China to establish legal framework for protection of property rights and to accelerate relevant legal reforms. The constitutional amendments gradually adopt expansive recognition of property rights; the enactment of real right law strengthens security of tenure and the recent regulation regarding demolition adds a significant portion of procedural protection. However, property rights protection in post-WTO China faces challenge as well. The incoherency is inevitable as between the previously ideologically constrained legal system and newly enacted legislatures. Critical issue such as expropriation has not been fully resolved. Systematic obstacles including household registration system and entrenched discriminative land policies cannot be phased out overnight. This paper addresses success and challenge faced by Post-WTO China, demonstrates how transitional nature of Chinese society affects development of legal system regarding property rights.
